Any collection, processing and use (hereinafter “use”) of data is solely for the purpose of providing our services. Our services have been designed to use as little personal information as possible. For that matter, “personal data” is understood as all individual details about a person or factual circumstances of an identifiable natural person (so-called “affected person”). The following statements on data protection describe what types of data are collected when accessing our website, what happens with these data and how you may object to data usage.
1 General information on data processing
1.1 Person responsible (controller)
Responsible within the meaning of the EU General Data Protection Regulation (GDPR) is:
KMG Global GmbH
Address: Rathausgasse 5, 12529 Schönefeld, Germany
E-mail: imprint (at) kmg-global.com
Homepage: https://kmg-global.com (opens in a new tab)
1.2 Protection of your data
We have taken technical and organizational measures to ensure that the requirements of the EU General Data Protection Regulation (GDPR) are met by us, as well as, by external service providers working for us.
If we work with other companies to provide our services, such as email and server providers, this will only be done after an extensive selection process. In this selection process, each individual service provider is carefully selected for its suitability in terms of technical and organizational data protection skills. This selection procedure will be documented in writing and an agreement on the order processing of data (data processing agreement) will only be concluded if the third party complies with the requirements of Art. 28 GDPR.
Our website is SSL/TLS encrypted, as can be seen by the https:// at the start of our URL.
1.3 Erasure of personal data
We process personal data only if necessary. As soon as the purpose of the data processing is fulfilled, erasure of the data is carried out according to the standards of the erasure concept, unless legal or contractual regulations oppose this.
2 Use of data on this website and in log files
2.1 Scope of processing personal data
This website consists of static pages. Fonts, images and scripts come from the same server as the pages. Only if you consent does it load Google Analytics from Google’s servers (section 3.2); without your consent it sets no cookies and loads no content from third parties.
When visiting our website, the servers of our hosting provider temporarily store every access in a log file. The following data is collected and stored until automated erasure:
- IP-address of the requesting computer
- Date and time of access
- Name and URL of the retrieved file
- Transmitted amount of data
- Message if the retrieval was successful
- Detection data of the browser and operating system used
- Website from which access is made
- Name of your Internet access provider
We or our partners may process additional data occasionally. You will find information about this below.
2.2 Legal basis for processing personal data
The legal basis for the temporary storage of the data and log files is Art. 6 para. 1 s. 1 lit. f) GDPR. Our legitimate interest is to make our website accessible for you.
2.3 Purpose of data processing
The processing of this data serves: the purpose of enabling the use of the website (connection establishment), system security and the technical administration of the network infrastructure. The IP address is evaluated only in case of attacks on the network infrastructure of our hosting provider.
2.4 Duration of storage
As soon as the purpose of the data processing is fulfilled, erasure of the data is carried out. GitHub logs visitors’ IP addresses for security purposes; GitHub’s privacy statement applies: https://docs.github.com/en/site-policy/privacy-policies/github-general-privacy-statement (opens in a new tab)
2.5 Right of objection and erasure
The data processing is necessary in order to present the website and to ensure the website’s operation. Therefore, objecting is impossible.
2.6 Hosting service provider
To make our website available, we use the services of the hosting provider GitHub, Inc., 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA (GitHub Pages). The processing is governed by GitHub’s Data Protection Agreement (Art. 28 GDPR).
If the hosting provider processes data outside the European Union, section 8 applies.
3 Cookies, analytics and local storage
3.1 Nothing without your consent
Without your consent this website sets no cookies and loads nothing from other servers. It uses no advertising tools, no social media plugins and no anti-spam services of third parties. The only analytics tool is Google Analytics 4 (section 3.2). On your first visit a banner asks whether you accept it. “Reject” is as easy as “Accept”, and until you accept, nothing from Google is loaded. You can change your choice at any time under “Privacy settings” at the bottom of every page.
3.2 Google Analytics 4
3.2.1 Description and scope of data processing
If you accept it, our website uses Google Analytics 4, a service for analysing access to websites provided by Google LLC (“Google”), which allows us to improve our website. Data processing for the European Economic Area and for Switzerland is carried out by: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Cookies (“_ga” and “ga” followed by an identifier) enable us to analyse your use of our website. The information collected may include
- IP address
- time of access
- duration of access
- from which website you came to our website
- interaction on the website
- device categories, browser type, operating system, screen resolution
and is transmitted to a Google server in the USA and stored there. The analysis of your activities on our website is transmitted to us in the form of reports. Google may pass on the information collected to third parties if this is required by law or if third parties process this data on behalf of Google. IP anonymisation is carried out by Google by default and cannot be deactivated, so IP addresses are only processed further in abbreviated form in order to exclude any possible direct personal reference to you. Google signals and Google’s advertising features are switched off on this website: your visits are not linked to a Google account and not used for advertising. You can find more information on the terms of use and data protection of Google Analytics at https://policies.google.com (opens in a new tab) and https://support.google.com/analytics/answer/6004245 (opens in a new tab).
3.2.2 Legal basis of data processing
The legal basis is your consent, Art. 6 para. 1 s. 1 lit. a) GDPR. Storing the cookies on your device and reading them is based on your consent under § 25 para. 1 of the German Telecommunications Digital Services Data Protection Act (TDDDG). For the transfer to the USA see section 8.
3.2.3 Purpose of data processing
By processing the data, we can analyse how our website is used, so we can improve it for our users.
3.2.4 Duration of storage
The data will be deleted 2 months after your last visit to our website. The cookies stay on your device for at most 13 months, unless you withdraw your consent or delete them earlier.
3.2.5 Right to withdraw consent and erasure
You can withdraw your consent at any time with effect for the future: open “Privacy settings” at the bottom of any page and choose “Reject”. Google Analytics then stops, and its cookies are deleted from this website. You can also prevent the installation of cookies from Google Analytics yourself by making the appropriate settings in your browser software, or deactivate Google Analytics with a browser extension, e.g. https://tools.google.com/dlpage/gaoptout (opens in a new tab).
3.3 Local storage
Your browser’s local storage keeps up to two entries from this website. They are not sent to us or to anyone else and stay on your device until you delete them in your browser’s settings. Both are strictly necessary to provide what you asked for, so they need no consent.
kmg.consent: your choice in the banner (accepted or rejected, and when), so that you are not asked again on every page.kmg.hcp: only if you confirm the self-declaration at the entrance to the section for healthcare professionals. It records that you have confirmed, so that you are not asked again on every page.
4 Contact
4.1 Contact us by e-mail or using a form
4.1.1 Description and scope of data processing
Via our website it is possible to contact us via e-mail or via contact form.
The contact form, the form for requesting samples and the form for reporting an adverse event do not send any data themselves. When you click “Write e-mail”, the form opens your own e-mail program with your message filled in and addressed to us. Nothing is transmitted until you send that e-mail yourself; we then receive and process your message as an e-mail.
This will require different data to answer the request, which will be automatically saved for processing. The following data are required to process your request:
- name
- e-mail address
- subject
- country
- message with all the data you disclose
Your data will not be passed on to third parties, unless you have given your consent. Reports of adverse events are the exception: we pass them on to the manufacturer (section 6).
4.1.2 Legal basis for data processing
The legal basis depends on Art. 6 para. 1 lit. b) or f) GDPR.
4.1.3 Purpose of data processing
The processing of personal data from the input form is used solely for handling the contact request.
4.1.4 Duration of storage
The data will be deleted as soon as we answer your request. There might occur rare cases when legal or contractual retention periods interfere with the erasure of your personal data. In this case your data will be deleted after these periods.
4.1.5 Right to objection and erasure
The user has the right to withdraw their consent to the processing of personal data at any time. If the user contacts us, they can object to storage of their personal data at any time. In such cases, the conversation cannot be continued. All personal data that has been stored in the course of the contact will be deleted.
5 Sample order
5.1 Description and scope of data processing
If you request a sample package from us and a delivery is agreed, we process the following data:
- Name
- Profession
- Country
- Delivery address (practice, institute, clinic or pharmacy)
- The products you request
You can also voluntarily provide the following information:
- The name of your institution or pharmacy
- A message
The form for requesting samples works like the contact form (section 4.1): it opens your e-mail program, and we receive your request as an e-mail.
For parcel deliveries, we pass on your name, address and e-mail address to our contractually bound processors and service providers.
5.2 Legal basis of data processing
The legal basis for the associated data processing is Art. 6 para 1. lit. b) GDPR, i.e. the processing of your data is necessary for the performance of the contracts and delivery agreements. We process the data that you have voluntarily provided on the basis of your consent in accordance with Art. 6 para. 1 lit. a) GDPR.
5.3 Purpose of data processing
We process your data in order to conclude the contract with you, including the delivery agreement, to ensure the contract is fulfilled, including on-time delivery, and to inform you about delivery dates and/or changes to the delivery.
We share your data with our service providers so that they can process the delivery and, if necessary, communicate with you to announce and coordinate the delivery of your ordered goods.
5.4 Duration of storage
Your data will only be stored for as long as necessary to fulfill the purpose and for as long as we are obliged to store your data by legal, contractual or official obligations.
5.5 Right to objection and erasure
The data processing is mandatory in order to process your sample request, which is why it cannot be dispensed with. There is therefore no option to delete it.
6 Recording of adverse reaction reports
6.1 Scope of processing personal data
We collect and process personal data as part of the reporting and follow-up of adverse reactions to our products that are necessary to fulfill our legal obligations in the area of vigilance. The processing includes the collection, storage and use of the data required for the evaluation and, if necessary, follow-up of the report.
The form for reporting an adverse event works like the contact form (section 4.1): it opens your e-mail program, and we receive your report as an e-mail. We pass every report on to the manufacturer, Ferdinand Eimermacher GmbH & Co. KG, who is legally obliged to record and assess it.
We process the following data:
- Surname, first name (title if applicable)
- Institution/stamp
- Address data
- E-mail address
- Telephone number
- Description of your adverse reactions
- Measures taken
- Gender
- Age
- Details of the product used
6.2 Legal basis for processing personal data
The processing of data for adverse reaction reports is carried out in accordance with Art. 6 para. 1 lit. c GDPR (legal obligation) and Art. 9 para. 2 lit. i GDPR (public interest in the area of health).
6.3 Purpose of data processing
The personal data collected is processed exclusively for the documentation, evaluation and, if necessary, reporting of side effects in connection with our products. This serves to fulfil legal obligations regarding product safety (vigilance) in accordance with the applicable regulatory requirements, in particular to monitor, analyze and minimize potential risks for patients and consumers.
6.4 Duration of storage
The data will be stored until the purpose of the data processing has been achieved and no legal, contractual or official retention obligations prevent deletion.
6.5 Right of objection and erasure
In addition to the right of access, you also have a right to rectification of the personal data stored about you, a right to erasure, a right to blocking and a right to transfer your data. Furthermore, you can object to this processing at any time by contacting us.
7 Links to other websites
This website links to online pharmacies that sell Deumavan, to the website of KMG Global GmbH (kmg-global.com) and to other websites, such as deumavan.com. Nothing is loaded from these websites while you read ours. Only when you click such a link does your browser leave this website and open the other one; from then on, its operator processes your data under its own privacy notice.
8 Service providers from third countries
In order to be able to provide our services, we use the support of service providers from third party countries (non-EU countries). In order to ensure the protection of your personal data in this case, we conclude processing contracts with each – carefully selected – service provider. All of our processors provide sufficient safeguards to implement appropriate technical and organizational measures. Our third country data processors are either located in a country with an adequate level of data protection (Art. 45 GDPR) or provide appropriate safeguards (Art 46 GDPR).
Adequate level of protection: The provider comes from a country whose level of data protection has been recognized by the EU Commission. These are examined and approved by the data security authorities within the framework of the consistency mechanism pursuant to Art. 63 GDPR.
Consent: In addition, a data transfer to a third country without an adequate level of protection will only take place if you have given us your consent in accordance with Art. 49 sec. 1 lit. a) GDPR for this purpose.
Google: if you accept Google Analytics (section 3.2), data may reach Google LLC in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework, for which the European Commission adopted an adequacy decision on 10 July 2023 (Art. 45 GDPR).
